These Terms of Service ("Terms") govern all purchases and use of since1871.store, operated by Since 1871, registered in the Netherlands (KvK: 97629359, VAT: NL005279284B27), 't Prooyen 4, 1141 VD Monnickendam. By placing an order, you unconditionally accept these Terms.
1. Products & Availability We strive to display product information, descriptions, and images as accurately as possible. As many of our products are handmade or fresh, slight variations may occur. Availability may change without notice.
2. Orders & Payment By placing an order, you make a binding offer to purchase. All orders are subject to acceptance and availability. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear to be placed for resale or in unusually large quantities. Payment must be completed in full before dispatch. Prices are in EUR and include applicable VAT. Shipping costs are shown separately at checkout. We reserve the right to correct pricing errors and cancel orders placed at an incorrect price.
3. Food Products — No Right of Withdrawal In accordance with Article 16(d) and 16(e) of the EU Consumer Rights Directive (2011/83/EU), the statutory 14-day right of withdrawal does not apply to our products, as they are perishable goods and/or sealed products that cannot be returned for hygiene or health protection reasons once opened or unsealed. All sales are final.
4. Refunds Refunds are not guaranteed and are assessed strictly on a case-by-case basis. A refund request will only be considered if: (a) the product arrived visibly damaged due to a shipping fault, or (b) the wrong product was delivered. Requests must be submitted within 48 hours of delivery to shopify1871@gmail.com with clear photographic evidence. Since 1871 reserves the sole right to determine whether a refund is warranted. Approved refunds are processed within 14 days to the original payment method.
5. Shipping & Delivery We ship orders worldwide using trusted carriers. Delivery times are estimates only and not guaranteed. Risk of loss and title pass to the customer upon handover to the carrier. Since 1871 is not liable for delays or losses caused by incorrect addresses provided by the customer, customs clearance, carrier failures, or circumstances beyond our control. For perishable goods, it is the customer's responsibility to ensure availability to receive the delivery.
6. Liability We are not liable for damages resulting from improper use or storage of our products. To the maximum extent permitted by applicable law, Since 1871's total liability for any claim shall not exceed the amount paid for the order in question. We are not liable for indirect, incidental, or consequential damages of any kind.
7. Misuse & Fraudulent Claims Since 1871 reserves the right to refuse future orders from customers who submit fraudulent, exaggerated, or bad-faith refund or chargeback claims. We cooperate fully with payment providers and relevant authorities in cases of suspected fraud.
8. Intellectual Property All content on this site (logos, texts, images, designs) is the property of Since 1871 and may not be copied, used, or reproduced without written permission.
9. Privacy & Data Protection We process personal data in accordance with GDPR. For details, please see our Privacy Policy.
10. Governing Law & Disputes These Terms are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam, Netherlands. EU consumers retain any mandatory statutory rights that cannot be contractually waived under applicable law.
